Freed from immigration detention, Chantal Morales Rojas will return home to Oakland ⁠42%

An Oakland resident arrested by ICE as she attempted to board a plane to fly home from Denver last week, and held for 10 days in a controversial Colorado detention center, walked free on Thursday. 
Clutching books and a water bottle, and wearing a “Bay Area” hat, Chantal Morales Rojas smiled and waved as she was met outside the gate of the Aurora ICE Processing Center by loved ones who had camped out all day awaiting her release. 
Morales Rojas had taken part in a short group trip to Denver for a frisbee tournament but was stopped, questioned, and arrested by immigration officials on the jetway of her flight home on July 20. 
Video of her arrest quickly went viral and became one of a few high-profile cases illustrating a recent surge in immigration enforcement inside airports. 
An unnamed ICE spokesperson told The Oaklandside last week that they detained her after she allegedly overstayed a visa that expired on Jan. 
4, 2025. 
Morales Rojas’ friends immediately mobilized to raise money and find an immigration attorney. 
Laura Lichter, a Colorado attorney, took on Morales Rojas’ case. 
On Tuesday, Lichter successfully petitioned an immigration judge to order Morales Rojas released on a $3,000 bond. 
“A $3,000 bond speaks for itself,” said Alicia Dantzker, a friend and supporter of Morales Rojas. 
“Chantal was never a danger to the community, and she was never hiding from immigration authorities. 
She had been living openly, working with government authorization, and complying with every requirement.” 
“The immigration judge's decision confirms that detention wasn’t necessary to ensure Chantal's appearance in court or protect the public,” said Lauren Cahr, another friend whose family also employed Morales Rojas as an au pair several years ago. 
Lichter has also filed a federal habeas corpus petition, essentially a lawsuit against ICE alleging that Morales Rojas was unlawfully arrested and detained. 
According to Lichter, the government arrested Morales Rojas without a warrant and did not make an individualized determination explaining why her detention was deemed necessary. 
Lichter said she’ll continue to litigate the habeas petition. 
“ICE still has not produced the records explaining why they arrested her or why they believed detention was justified. 
We will continue this fight because the public deserves to know whether the government followed the law before taking away someone's liberty,” she said. 
In response to questions from The Oaklandside about whether ICE had a proper arrest warrant, an ICE spokesperson sent the same general statement they emailed last week about Morales Rojas' case: “In violation of our nation’s laws, she overstayed her visa,” they wrote. 
“We are just so relieved that she is going home, but we're going to keep asking the questions ICE still refuses to answer,” said Cahr about her friend. 
ICE’s Aurora holding center, which is run by the private prison company GEO Group, has recently been the site of a tuberculosis outbreak. 
The jail has been accused of blocking state and local health officials from investigating the problem. 
“We're grateful that she is finally going home, but we're going to keep asking the questions ICE still refuses to answer,” said Dantzker.
