Fred Burton, the incumbent mayor of Arcola, was arrested and booked into Fort Bend County Jail on five felony charges around 10:30 p.m Tuesday, according to court records.
Burton is facing various charges, including two counts of illegal voting, one count of misuse of official information, one count of tampering with government records with intent to defraud or harm, and one count of fraudulently securing the execution of a document.
The illegal voting charges come from two different elections  the Arcola Municipal Runoff Election on June 7, 2025, and the April 23, 2026, City of Arcola General, Joint, and Special Election.
According to the indictments, Burton allegedly assisted, encouraged, or failed to prevent non-eligible voters from voting despite knowledge of their ineligibility.
The other three charges are from his time as mayor in 2023.
Burton allegedly used his office as mayor to disclose non-public information regarding a competitive city contract to another person for a "non-governmental purpose."
He is also accused of making, presenting or using a false government estimate for the Arcola Food Court Project.
The last indictment alleges Burton caused two council members to execute a document regarding city finances valued between $30,000 and $150,000 without their consent.
Burton won the 2026 Arcola mayoral election against former Mayor Veeda V.
Williams by 22 votes.
In a Facebook post on Wednesday morning, Williams said, "I think what today’s headline illustrates is that the people matter and leadership should always be held accountable to those whom they serve."
Burton’s office declined to comment.
The Arcola mayor has been involved in a slew of heated confrontations during his time in city government.
Most notably, the legal battles with Councilwoman Ebony Sanco in 2024.
The Houston Landing found that he used almost $8,000 of public funds to hire a private investigator to look into Sanco’s residency.
According to the Fort Bend County District Attorney’s office, Burton appeared before a magistrate judge.
His bonds were set on Wednesday.
They were set at $25,000 for each charge of illegal voting, $20,000 for the misuse of official information charge, $20,000 for the fraud charge and $15,000 for the tampering with a government record charge.
